This policy explains which personal data we process when you visit the website actionparkvalais.ch and when you join the Action Park Valais waiting list, why we process it and what your rights are. It is drawn up in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR).
1. Data controller
[To be completed: company name and legal form]
[To be completed: street and number]
[To be completed: postcode and town], Switzerland
Email: [To be completed: contact email address]
For any question about your data or to exercise your rights, please write to us at this address.
2. Visiting the website
When you visit the website, our hosting provider’s server automatically records technical data in its access and error logs: IP address, date and time of the request, page requested, referring page, browser and operating system.
This data is used only to display the website, keep it secure and diagnose faults. It is not used to identify you and is kept by the hosting provider for a limited period. Legal basis: our legitimate interest in running a safe and working website (Art. 6(1)(f) GDPR).
3. Joining the waiting list
Data collected
When you join the waiting list, we process:
- your email address, the only data you enter;
- your consent, given by ticking the box provided for this purpose;
- the IP address, date and time of your sign-up, which serve as proof of your consent;
- the language of your sign-up and where it came from (the form on this website).
Purpose and legal basis
This data allows us to send you Action Park Valais news by email: behind the scenes of the project, the opening announcement and early-access invitations. This processing is based on your consent (Art. 6(1)(a) GDPR), which you can withdraw at any time.
When your sign-up takes effect
Your sign-up takes effect as soon as you submit the form, without a confirmation email. If your address was signed up by mistake, the unsubscribe link in every email removes you from the list in one click; you can also write to us. Only re-subscribing an address that was previously unsubscribed requires a confirmation email.
Open and click tracking
Our emails may contain an invisible pixel and tracking links that tell Mailchimp whether a message was opened and which links were clicked. We use these statistics, in aggregate, to improve our emails. You can avoid this tracking by turning off the automatic display of images in your email program.
Unsubscribing and retention period
Every email contains an unsubscribe link; you can also write to us. Your data is kept for as long as you are subscribed. After you unsubscribe, your address is kept with the status “unsubscribed”, solely to make sure that you no longer receive any emails; you can ask us to delete it permanently.
Protection against abuse
To prevent automated sign-ups, the form includes an invisible field intended for bots, and your browser solves a small calculation before sending (ALTCHA, hosted on our own server): this check sets no cookie, records no data about your behaviour and uses no third-party service. The number of submissions is also limited to five per ten-minute period: your IP address is used for this purpose in pseudonymised form and deleted automatically after ten minutes. Legal basis: our legitimate interest in protecting the service (Art. 6(1)(f) GDPR).
4. Cookies and audience measurement
This website sets no cookies on your device and uses no audience measurement, advertising or social media tools. Fonts, images and videos are hosted on our own server: displaying them sends no data to third parties.
The only exception: if you pause the background video, your browser remembers this choice (local storage, key apv-background-video-paused) so as not to restart the video on your next visit. This information stays on your device, is never sent to us and can be deleted at any time from your browser settings.
5. Recipients and processors
Your data is never sold, rented or transferred. It is accessible only to the people in charge of the project within our organisation and to the following service providers, who process it on our behalf:
- Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Les Acacias (GE), Switzerland: hosting of the website and its database, in Switzerland.
- The Rocket Science Group LLC (Mailchimp, an Intuit company), 405 North Angier Ave. NE, Atlanta, GA 30308, United States: management of the waiting list and sending of emails. See its privacy statement.
We may also be required to disclose data to the authorities where the law requires it.
6. Transfer of data abroad
Waiting list data is stored by Mailchimp in the United States. Mailchimp is certified under the Data Privacy Framework (Swiss–US and EU–US), which the Swiss Federal Council and the European Commission recognise as ensuring an adequate level of protection for certified companies. Its data processing agreement also includes the European Commission’s standard contractual clauses. The certification can be checked on dataprivacyframework.gov.
7. Your rights
You can at any time:
- find out whether we process data about you and obtain a copy of it;
- have it corrected if it is inaccurate;
- ask for it to be deleted;
- withdraw your consent, without affecting processing already carried out;
- object to processing or ask for it to be restricted;
- receive the data you have provided to us in a common format, or have it transferred to another controller.
To exercise these rights, write to us at the address given in section 1. We will reply within 30 days and may ask you to prove your identity.
If you believe that your rights have not been respected, you can contact the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, www.edoeb.admin.ch. If you live in the European Union, you can also lodge a complaint with the supervisory authority of your country (in France, the CNIL).
8. Security
The website can only be accessed over an encrypted connection (HTTPS). Access to the website administration and to the Mailchimp account is restricted to authorised people and protected by password.
9. Changes to this policy
We may update this policy, for example when the park opens or when new services are added. The version in force is always the one published on this page, with its last updated date.
